A new Nebraska law addresses who owns data generated on the farm. The state’s Agricultural Data Privacy Act treats agricultural data as the property of the farmer who generates it. That can include GPS information, yield data, agronomic records, livestock genetics, land information and machinery data. The law generally allows agricultural technology companies to use data for authorized services but restricts the sale of raw agricultural data without the farmer’s express written consent. Beginning January 1, 2027, new contracts covering agricultural data must prohibit its sale without that consent.
