The U.S. government says a federal appeals court should reverse a lower court verdict finding Bayer liable in the case of a California man who blamed Bayer’s Roundup herbicide for his cancer. In a court brief, the Environmental Protection Agency and the U.S. Justice Department say the active ingredient in Roundup is not a carcinogen. As a result, a warning on the label was not required as California law stipulates. The EPA and Justice Department also say it is unlawful for manufacturers and sellers of chemicals to make claims or changes on their labels that differ from what EPA approves which the California law requires.
