North Dakota Senator Kevin Cramer say the new Waters of the United States definition being considered by the White House Office of Management and Budget lays the foundation to continue the conversation on a new WOTUS rule. “This temporary definition takes the previous Supreme Court cases and pre-Obama era definition of WOTUS. Going forward, I have no doubt they want to expand on the definition and to have a process that’s inclusive.” For the next step in the rule-making process, states and organizations are applying to host one of 10 virtual WOTUS listening sessions across different regions of the country. The deadline to apply is coming up in early November. Cramer is still expecting an in-person WOTUS meeting in North Dakota and hopes to know more details before the end of the year.
