With a unanimous vote, the South Dakota Supreme Court ruled Summit Carbon Solutions cannot use eminent domain to survey land. The Summit project would capture CO2 from 57 ethanol plants in Iowa, Minnesota, Nebraska, South Dakota and North Dakota. The carbon will be shipped and sequestered underground in North Dakota. This project would allow ethanol produced at these ethanol plants to be a net-zero fuel by 2030. It allows the ethanol companies to meet low carbon fuel standards, providing access to the sustainable aviation fuel market.
