Domina Law Group Managing Attorney Brian Jorde works with landowners on property rights law throughout the Midwest and led a breakout session at the NFU Convention. Jorde said the recently passed South Dakota Landowner Bill of Rights failed to address real concerns from producers. “It didn’t touch the invasive surveying activities and it didn’t touch eminent domain.” Jorde argues the Fifth Amendment says property cannot be taken for private use. “That’s been watered down where we’re at now and any vague public benefit is potentially a justification and those are the laws that need to be addressed.”
