A federal court vacated the registration of over-the-top dicamba products earlier this month. In light of the court’s order, EPA is allowing the limited sale and distribution of existing stocks of the dicamba products. North Dakota Agriculture Commissioner Doug Goehring said this decision provides certainty to the farmer. However, Goerhing advises farmers to contact their ag retailers to secure these products. “The place where you’ll see pressure on this will be in the South where 85 percent of the cotton acres are a dicamba technology so those guys will definitely be scrambling to make sure that they have theirs to treat their cotton and I don’t want anybody in the Northern Plains to be caught unaware.” Bayer, BASF and Syngenta could have appealed, but a court decision likely wouldn’t have occurred before spring planting.
