The Ninth Circuit Court of Appeals in San Francisco upheld a permanent injunction, finding it unconstitutional to force Bayer and other ag companies to include a warning label for glyphosate. California’s warning label would link the use of glyphosate to cancer, which plaintiffs called “false and misleading.” The National Association of Wheat Growers was the lead plaintiff. Thirteen other organizations, including the North Dakota Grain Growers Association, South Dakota Agri-Business Association, National Corn Growers Association and U.S. Durum Growers Association, participated in the lawsuit.
