The Environmental Protection Agency has filed an appeal in the current litigation over the controversial Waters of the United States rule. Injunctions were granted by federal courts in North Dakota and Texas, putting WOTUS on hold in 26 states. At this point, EPA has filed the notice to appeal in the Texas case, but not in North Dakota. This issue is further complicated by a WOTUS case that is pending in the U.S. Supreme Court.
