The federal appeals court in Washington, D.C. ruled oil refiners failed to prove the 2019 volumes within the Renewable Fuel Standard caused economic harm to the industry. Growth Energy wanted 4.3 billion gallons restored to the RFS due to the small refinery waivers, but the court denied that challenge. However, the appeals court determined the EPA must take another look at the RFS’s impact on endangered species and the environment. Friday’s ruling was made just one week after the same court vacated the EPA rule allowing for the year-round use of E15.
