The Trump administration is asking the Supreme Court for an additional month to respond to a petition from oil refiners on small refinery exemptions. Growth Energy CEO Emily Skor said the ethanol industry doesn’t understand why the EPA needs more time. “The agency and administration chose not to appeal the court’s decision from early 2020. We want the agency to put clarity back to the Renewable Fuel Standard so we can move on.” There is uncertainty regarding EPA’s actions the rest of the year. “There’s a backlog of regulatory action before the EPA and we need to get things moving. Rule-making is unlikely to happen in this short time window. EPA can deny small refinery exemptions on their own, but getting the proposed and final 2021 Renewable Volume Obligations will require rulemaking.” Skor said the final RVOs will likely be addressed in 2021.
