The U.S. Supreme Court is the only option left for Bayer, Corteva Agriscience and BASF to overturn the decision to vacate the registration of Xtendimax, FeXapan and Engenia. The 9th Circuit Court of Appeals rejected a request for a rehearing before the full panel of judges. That leaves the court’s June dicamba ruling in place. Bayer, Corteva and BASF are seeking EPA re-registration of their dicamba products for the 2021 growing season.
