BASF and Corteva Agriscience recently filed separate petitions asking for a rehearing in the Ninth Circuit Court’s June 3 decision to vacate the registration of their dicamba herbicides. Drake Agricultural Law Center Director Jennifer Zwagerman doesn’t anticipate big changes coming to the current registration. “The current registration expires in less than six months anyway, but it’s a matter of getting this information into the record for whatever else is coming down the pipeline legally,” explains Zwagerman. The court challenges will likely continue. “We need to find a way to provide farmers with the tools they need in the short-term to be successful, while also looking at the long-term sustainability implications.” In preparation for next year, Zwagerman encourages farmers to vet the regulatory environment when making weed control decisions. “The best thing to do is really talk with advisors, Extension agents or others and try to understand all of the options.”
