BASF and Corteva Agriscience have filed separate petitions, seeking a rehearing in the court decision to vacate the registration of their dicamba herbicides. In the original decision, three judges determined the EPA did not conduct a proper environmental review of dicamba. BASF and Corteva now want all of the judges in the Ninth Circuit to rehear the original case. If that review is not granted, the next step in the appeals process would be the U.S. Supreme Court. In a statement, BASF said the original ruling was “unprecedented and devastating to tens of thousands of farmers” who depend on the over-the-top application of these dicamba-based products.
