Waters of the United States is back in effect in Minnesota and 25 other states. A federal judge in South Carolina has issued an injunction on a recent EPA decision that delayed implementation of the controversial WOTUS rule. Environmental groups sued EPA, claiming the agency did not go through the proper procedures when issuing the WOTUS delay. The American Farm Bureau Federation released a statement, saying this was a “misguided ruling.” Due to legal action in other courts, North Dakota, South Dakota and 22 other states are not impacted by the court injunction.
