EPA Administrator Michael Regan heard from North Dakota agriculture, energy and water industries during his visit to North Dakota. The Waters of the United States rule was a big part of the discussion. “There are aspects of the current rule I believe are unlawful. They were hard to implement in North Carolina,” said Regan. “There are also aspects that don’t offer protections to states with different geographical considerations than North Dakota.” North Dakota Agriculture Commissioner Doug Goehring offered considerations. “North Dakota is diverse; a one size approach doesn’t fit all,” said Goehring. “The 2018 rule created regulatory certainty. I’d sooner not go down this road (another WOTUS revamp), but we want to develop a working relationship and an understanding of what is being requested.” EPA will return to North Dakota for an official WOTUS listening session.
