An emergency order was filed Thursday night asking the courts to end the use of Xtendi Max, Engenia and FeXapan and hold EPA Administrator Andrew Wheeler in contempt of court for allowing farmers and custom applicators to use the dicamba products they had in stock on June 3. This motion came from the original plaintiffs, which include the Center for Food Safety and the Center for Biological Diversity. These activist groups argue the EPA acted unlawfully by allowing the continued use of the existing supply of dicamba products. It’s not known when the judges will rule on this motion.
