Environmental Protection Agency Administrator Andrew Wheeler issued a statement on the Ninth Circuit Court of Appeals decision to ban the registration for three dicamba products: Xtendimax, FeXapan and Engenia. Wheeler acknowledges farmer’s responses since the court’s decision and says the agency is assessing all avenues to mitigate the impact of the court’s decision on farmers. All eyes are on EPA’s formal response to determine what happens next. In the meantime, the states are making some decisions. As of Sunday evening, several states including North Dakota have decided to honor their state dicamba registration. That means it’s still legal to apply the products. In Minnesota, the use of the three dicamba products is banned. South Dakota will provide more guidance once it’s received from the EPA.
