The National Association of Wheat Growers is backing the U.S. Supreme Court’s decision to review Monsanto Co. v. Durnell, a case that could clarify whether the Federal Insecticide, Fungicide, and Rodenticide Act blocks state failure-to-warn claims when the EPA hasn’t required a label warning. Oral arguments haven’t been scheduled, but a decision could come as soon as this summer. “NAWG welcomes the Supreme Court’s review of this case, which touches on a critical issue for America’s farmers,” said Sam Kieffer, NAWG CEO. “EPA-approved crop protection tools are rigorously evaluated to ensure they can be used safely and responsibly. When state lawsuits clash with federal approvals, it creates uncertainty for farmers trying to protect crops and keep food safe and affordable. We hope the Court’s decision reinforces the value of a consistent, science-based federal system for crop protection.”
