The North Dakota Supreme Court heard oral arguments Thursday in a case that could impact the state’s carbon sequestration project. The Northwest Landowners Association is suing the State of North Dakota and the State Industrial Commission over a law that forces landowners to allow CO2 storage underneath their land if 60 percent of the landowners agree to the project. NDFB has joined the landowner group in this lawsuit. The state has the support of Minnkota Power, Basin Electric Power, Dakota Gasification and Summit Carbon Solutions. The court took the case under advisement.
