The Eighth Circuit Court of Appeals ruled the Surface Transportation Board does not have the authority to streamline rate dispute settlements between railroads and shippers. This limits the ability of grain elevators to challenge freight rates. The new rate review process means the STB must choose either the rate proposed by the railroad or the shipper without doing its own analysis.
