A federal appeals court vacated most of EPA’s 2022 denials of small refinery exemptions from the Renewable Fuel Standard. The court remanded these petitions to EPA for further action. The Renewable Fuels Association, Growth Energy and the American Coalition for Ethanol said they are “extremely disappointed” with the court decision. The ethanol groups said they are considering their next step, but remain committed to defending the proper implementation of the RFS.
