North Dakota has joined 23 other states challenging the U.S. Environmental Protection Agency and the U.S. Army Corp of Engineer’s revised definition of the Waters of the United States rule. North Dakota Agriculture Commissioner Doug Goehring says the revised rule is a blatant overreach of authority that significantly and unlawfully expands federal control over state and local land and water resources. North Dakota Attorney General Drew Wrigley filed the lawsuit in U.S. District Court in North Dakota challenging the new definition of WOTUS.
