At least three things come to mind looking back at the challenging regulatory environment: the Waters of the United States rule, chlorpyrifos and dicamba. The Environmental Protection Agency is re-defining WOTUS again. Agriculture wants certainty and the EPA wants a definition that will withstand changing administrations. EPA officials made two trips to North Dakota in 2021 for input. In the new year, the EPA plans to host 10 regional roundtable listening sessions to get additional feedback. In early fall, the EPA banned the use of chlorpyrifos on U.S. food crops. More than 80 ag groups filed a formal objection with the decision. Ahead of the holidays, EPA released a memorandum reviewing 2021 dicamba incidents, but did not outline what would happen with use in 2022. Agriculture groups and states want more clarity. In December, the Minnesota Ag Department proposed dicamba application cutoff dates for next year. More will be known about those proposed changes in 2022.
