The Supreme Court heard oral arguments from the EPA, biofuels industry groups and oil refiners on the use of small refinery exemptions. The oil industry argues it’s in compliance to allow small refineries to petition for an exemption at anytime. Agriculture and biofuel groups say the small refinery waivers are being abused and weaken the Renewable Fuel Standard. National Corn Growers Association CEO Jon Doggett is optimistic, but says time will tell. “It will be some weeks or a couple of months before the justices render their final opinion. We think it’s a fairly straight-forward case. We are hoping for a good outcome.” NCGA, the National Farmers Union, Renewable Fuels Association and American Coalition for Ethanol were all part of Tuesday’s hearing.
