It’s been a dizzying start for 2021 for the U.S. biofuels industry. On Friday, January 8, the Supreme Court said they would review a court case on small refinery exemptions. Shortly after, there were rumors the EPA would approve at least 20 pending small refinery exemptions from 2019. “There was a flurry of activity to work with our champions of Congress to prevent this from happening and it looks like we may have been successful.” Now, American Coalition for Ethanol CEO Brian Jennings says the EPA issued a series of parallel proposals to loosen retailer restrictions on E15 and open a request for comment on additional Renewable Fuel Standard waivers. “If you take those two things together, it washes out any benefit from the E15. We’ll have our work cut out for us to advance and support the E15 proposal and put the brakes on any further effort from EPA to grant more waivers.”
