On Monday, the Environmental Protection Agency said they would deny retroactive small refinery exemptions, the so-called “gap-filling” petitions for the 2011-18 compliance years. “If the EPA will denies the retroactive exemptions, that’s very good news for the ethanol industry and farmers,” said Geoff Cooper, CEO, Renewable Fuels Association. “The proof will be in the pudding.” There are unresolved issues with the agency and the Renewable Fuel Standard, including the delayed 2021 Renewable Volume Obligations. “At this point, I think it would be very difficult, if not impossible, for the EPA to finalize the 2021 RVOs before November 30. They haven’t even proposed the rule yet. We are concerned that rule making will slip passed the election.”
