The Eighth Circuit Court of Appeals has upheld a lower court decision, preventing the enforcement of a 2017 North Dakota law supported by the North Dakota Implement Dealers Association. The Association of Equipment Manufacturers and large farm equipment companies sued the State of North Dakota two years ago, saying the law was unconstitutional. The law would impose restrictions on farm equipment manufacturers and their enforcement of dealer contracts. It would give dealers the right to comingle facilities, personnel and display space to promote a competitor’s products.
