A lawsuit over the Waters of the United States rule has been filed in New Mexico. Pacific Legal Foundation senior attorney Tony Francois is part of this legal action. “This lawsuit challenges the recent decision by the EPA to reimpose a very set of regulations that very, very broadly defines their authority under the Clean Water Act,” said Francois. “These regulations have already been found invalid by the Supreme Court and yet they’re re-imposing them; that’s why we’re challenging.” The request has been filed for an injunction preventing the EPA and Army Corps of Engineers from using these old rules to regulate drainage and isolated ponds on private property. A ruling should be made within the next few months. Francois says the stakes are high for farmers and ranchers.
